Federal High Court in Benin City has dismissed a suit filed by Kenneth Imansuangbon challenging the nomination of Olumise Akpata as the candidate of the Labour Party for the governorahip election in Edo State.
The court ruled that it lacked jurisdiction to entertain the suit which it said lacks merit and was based on speculatio.
Justice B. O. Quadri ruled that Imansuangbon failed to exhaust internal dispute resolution mechanisms within the Labour Party before seeking legal action, which he held robbed the court of jurisdiction in the matter.
The court further said that Imansuangbon’s claim of Akpata not signing the Indemnity Form is statute-barred.
Declaring the lawsuit premature and without substantial evidence to support its claims, Justice Quadri therefore upheld Akpata’s candidature for the September 21, 2024 election.
